Health and Safety Disclosure

Ananda Tours is committed to providing a safe and enjoyable experience for all guests, staff, and partners. While all reasonable care is taken to manage risks, participation in tours involves inherent hazards associated with travel, vehicle transportation, alcohol consumption, and visiting rural, coastal, and vineyard environments on Waiheke Island.

Health, Safety and Guest Conduct

Guests must comply with all instructions provided by Ananda Tours drivers, guides, staff, and venue hosts in relation to health and safety. All passengers are required to wear seatbelts at all times while travelling in Ananda Tours vehicles, in accordance with New Zealand transport legislation.

Many tours include visits to licensed premises where alcoholic beverages may be served. Guests are expected to consume alcohol responsibly and behave in a respectful manner toward other guests, staff, and venue hosts. Ananda Tours reserves the right to refuse service, restrict participation in tastings, or remove any guest from a tour if they are considered intoxicated, behaving in a disruptive or unsafe manner, or if their conduct may pose a risk to themselves, other guests, staff, or suppliers. In such circumstances, Ananda Tours accepts no responsibility for any additional costs incurred and no refunds will be provided.

Guests acknowledge that locations visited may include uneven surfaces, steps, gravel paths, vineyards, walking tracks, art studios, coastal environments, and other natural features where hazards may exist. Guests participate in tours at their own risk and are responsible for exercising reasonable care for their own safety. Appropriate footwear and personal care are recommended.

To the maximum extent permitted under New Zealand law, Ananda Tours, its employees, contractors, and suppliers shall not be liable for any injury, loss, damage, delay, or expense arising from participation in a tour, except where liability cannot be excluded under the Health and Safety at Work Act 2015, the Consumer Guarantees Act 1993, or other applicable legislation.

By confirming a booking or participating in an Ananda Tours experience, guests acknowledge and agree to comply with these Health and Safety and Guest Conduct conditions.

Medical Conditions and Mobility

Guests are responsible for ensuring that they are physically able to participate in the tour and its activities. Some tour locations may involve walking on uneven surfaces, gravel paths, vineyard terrain, steps, or other natural environments that may not be suitable for all mobility levels.

Guests with medical conditions, mobility limitations, allergies, or other health concerns that may affect their participation must advise Ananda Tours at the time of booking or prior to the tour departure. While we will make reasonable efforts to accommodate guests where possible, Ananda Tours cannot guarantee that all venues, vehicles, or locations visited will be fully accessible.

Ananda Tours accepts no responsibility for any medical issues, injuries, or complications arising from undisclosed health conditions.

Weather, Environmental and Operational Safety

Tours operate in a range of weather and environmental conditions typical of Waiheke Island. While every effort is made to operate tours as scheduled, Ananda Tours reserves the right to alter itineraries, substitute venues, adjust timings, or cancel activities where necessary due to weather conditions, safety concerns, operational requirements, or circumstances beyond our control.

This may include but is not limited to severe weather, ferry disruptions, venue closures, road conditions, or other safety-related factors.

Where itinerary changes are necessary, Ananda Tours will make reasonable efforts to provide suitable alternatives. Such changes do not constitute grounds for refund where the tour has otherwise substantially operated as planned.

Third-Party Transport, Activities and Suppliers

Some tours may include or require services provided by independent third-party operators, including but not limited to ferry companies, helicopter operators, private charter boats, adventure activity providers (such as zipline experiences), wineries, restaurants, and other venues.

Where Ananda Tours makes reservations or bookings with these suppliers on behalf of guests, Ananda Tours acts only as a booking agent for those services. These suppliers are independent businesses that operate under their own licences, safety procedures, operational standards, and terms and conditions.

Participation in services provided by third-party operators is subject to the terms, conditions, and safety requirements of the relevant supplier. Guests may be required to sign separate waivers, acknowledgements, or safety documentation directly with the operator prior to participation.

While Ananda Tours works with reputable suppliers and will use reasonable care in selecting and coordinating services, Ananda Tours does not control the operations of these third-party providers and accepts no responsibility for any loss, injury, damage, delay, cancellation, schedule change, or additional expense arising from the acts, omissions, or operational decisions of these operators.

This includes, but is not limited to, disruptions caused by ferry schedules, weather conditions affecting helicopter or marine transport, mechanical issues, operational changes, or safety-related decisions made by the supplier.

To the fullest extent permitted under New Zealand law, Ananda Tours shall not be liable for any injury, loss, damage, delay, or expense arising from services provided by third-party operators. Guests acknowledge that participation in such services is at their own risk and agree to comply with all instructions and safety requirements of the relevant provider.
